NYC Permanent Dining Out Program

Deadline: August 3, 2024

Applications for Dining Out NYC, the city's new permanent outdoor dining program, are now open. Apply here

The City has created step-by-step, interactive guides to help food and drink establishments understand the requirements for roadway cafes and sidewalk cafes. The guides cover information ranging from how far a roadway cafe must be from a crosswalk or fire hydrant, to materials requirements, to how to clean in and around your cafe.

Establishments with existing temporary outdoor dining setups must apply by August 3, 2024. These establishments will need to bring their existing setup into compliance with Dining Out NYC requirements within 30 days after application approval. If you have an existing temporary setup and do not apply by August 3, 2024, you will be required to remove your setup.
